Delivery times are estimates only and are not guaranteed. Delays may occur due to high order volume, weather conditions, traffic, or other circumstances beyond our control. We are not liable for any damages arising from delivery delays. Delivery fees, if applicable, will be disclosed at checkout. Risk of loss and title for items purchased from us pass to you upon delivery to the designated delivery address.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GREEN LANTERN PIZZA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, PARTNERS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, PERSONAL INJURY, OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
- Your use of or inability to use our Site or services.
- Any goods or services purchased or obtained through our Site.
- Unauthorized access to or alteration of your transmissions or data.
- Statements or conduct of any third party on or through our Site.
- Any other matter relating to our Site or services.
IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR SITE OR SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO GREEN LANTERN PIZZA IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
These limitations apply regardless of whether the liability is based on warranty, contract, tort, negligence, strict liability, or any other legal theory, and even if we have been advised of the possibility of such damages.
Certain states, including New Jersey and Massachusetts, do not allow the exclusion or limitation of incidental or consequential damages. In such states, the above limitations may not apply to you.
9. Indemnification
You agree to defend, indemnify, and hold harmless Green Lantern Pizza, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

13. Dispute Resolution
13.1 Informal Resolution

We will attempt to resolve the dispute within thirty (30) calendar days of receiving your written description. If we are unable to resolve the dispute informally within that period, either party may proceed to formal dispute resolution as described below.
13.2 Binding Arbitration
If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or your use of our services — including questions about the validity, interpretation, or enforceability of these Terms — shall be resolved by binding arbitration conducted by a single arbitrator in accordance with the rules of the American Arbitration Association (AAA) or another mutually agreed arbitration provider. The arbitration shall be conducted in English, and the arbitrator's award shall be final and binding on both parties.
The arbitration shall take place in the United States, in a location mutually agreed upon by the parties or, if the parties cannot agree, as determined by the arbitration provider. The arbitrator may award any relief that a court of competent jurisdiction could award, including injunctive or declaratory relief, but the arbitrator may not consolidate claims or preside over a class or representative proceeding.
13.3 Class Action Waiver
YOU AND GREEN LANTERN PIZZA AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. UNLESS BOTH PARTIES AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING.
13.4 Exceptions
Notwithstanding the foregoing, either party may seek emergency injunctive or equitable relief from a court of competent jurisdiction to prevent irreparable harm pending the outcome of arbitration. Claims for collection of amounts owed by you for services rendered may also be pursued through other legal remedies available under applicable law.
14. Term and Termination
These Terms are effective as of the date you first access or use our Site or services and shall remain in full force and effect until terminated.
We reserve the right, in our sole discretion, to suspend, restrict, or terminate your access to our Site or services at any time and for any reason, including but not limited to your violation of these Terms, conduct that we believe is harmful to other users or to us, or applicable legal requirements, without notice and without liability to you.
You may terminate your use of our Site at any time by ceasing to access the Site. If you have an account with us, you may request deletion of your account by contacting us at [email protected].
Upon termination of your access, any outstanding orders that have already been confirmed and are in process will still be fulfilled. However, we reserve the right to cancel any pending unconfirmed orders without liability.
